1. In the past five years, how much money has your health board paid out in compensation in relation to childbirth or maternity service negligence claims?

£19,500.

2. How many patients were paid in each year?

The number is less than five and in a small community providing this information runs the risk of identifying how much and to whom compensation has been paid.

Where we have used <5, this is because, in accordance with FOISA s 16(1), NHS Shetland confirms that it holds the information requested but that it is exempt from disclosure under FOISA s 38(1)(b) as read with s 38 (2A) as the information constitutes personal data and disclosure would breach the confidentiality of the data subjects.
