Negligence Claims - FOI Response Register

1. For the financial years 2019/20 to 2024/25, please provide the total amount of pay outs following successful medical negligence claims.

We are unable to provide the requested information as, although the information would not necessarily be disclosive in isolation, NHS Shetland must consider all information that may be publically available. NHS Shetland has previously published information relating to claims and this information, in combination with the requested information, would carry a high risk of identifying and/or disclosing information about individuals.

In accordance with FOISA s 16(1), NHS Shetland confirms that it holds the information requested but that it is exempt from disclosure under FOISA s 38(1)(b) as read with s 38 (2A) as the information constitutes personal data and disclosure would breach the confidentiality of the data subjects.

2. Over the same time period, please provide me with the highest single medical negligence pay out.
