1. Any current policy of your Health Board concerning the provision of separate changing facilities for women.
2. Confirmation as to whether your Board accepts that separate facilities must be provided for women, and details of the steps being taken to ensure compliance with this legal duty.
3. Internal documents, including but not limited to advice, submissions, and emails that provide advice or consideration of these matters to Board members.
4. Correspondence, whether by email or otherwise, between your Board and the Scottish Government concerning advice or guidance on this matter to date.
The Equality and Human Rights Commission (EHRC) is developing a revised Code of Practice following the ruling of the Supreme Court which will advise Scottish Government on the updated interpretation of the Equality Act 2010, this will then be used to review all policies and practices across NHS Scotland. As we await guidance from EHRC and Scottish Government we will continue to adhere to the Equality Act 2010
An audit of current policies, practices and facilities are currently being undertaken in preparation for any changes to be implemented
We will be providing general communications to all staff via our Communications bulletin that will include information on the Ruling, the implications of this and the steps that will be taken. We will also offer colleagues staff support and key contacts. We will also advise that NHS Shetland are committed to ensuring that all patients, staff, and visitors are treated with dignity, respect, and care and take our legal responsibilities seriously. We strive to implement policies that respect the dignity and comfort of everyone while adhering to legal and ethical standards.
